Terms of Use
1. Provider and Contract
SonWeave AI Notes is provided by Silestis Labs UG (haftungsbeschränkt), registered in the commercial register of the Local Court of Munich under HRB 309539, VAT identification number DE460212346 (the "Provider"). You can reach us by email at hello (at) silestis.com. You may also use this email address for data protection inquiries, accessibility notices, and reports of unlawful content, unless a more specific form is provided on our website.
These Terms govern the use of SonWeave AI Notes for personal or internal professional purposes. They supplement the Apple Media Services Terms and govern the user's relationship with the Provider. Any applicable third-party terms also apply.
2. The App
SonWeave AI Notes records or imports audio and video and can create, edit, organize, search, play, export, and share transcripts and notes. Depending on the device and enabled features, it may also provide speaker labels, vocabulary, cleanup, summaries, chapters, key points, study questions, translation, bookmarks, and local AI functions.
SonWeave AI Notes is designed to process and store user content locally on the user's device. The Provider's own services do not receive or store user recordings, transcripts, notes, or AI results. Optional features such as iCloud Sync, export, sharing, or opening content in another app may transfer or store content through Apple or the service selected by the user. Those services are governed by their own terms and privacy policies.
Features may change for security, legal, technical, or reasonable product-development reasons. Necessary updates, including security updates, will be provided and announced as required by applicable law. If a change materially impairs use and no reasonable alternative is provided, the user's statutory rights remain unaffected.
3. Licence
The Provider grants the user a limited, non-exclusive, non-transferable, non-sublicensable licence to install and use SonWeave AI Notes on Apple devices owned or controlled by the user, as permitted by the Apple Media Services Terms. Family Sharing and associated accounts are permitted where Apple allows them. All other rights remain with the Provider.
The user must not copy, distribute, sell, rent, modify, decompile, reverse-engineer, or attempt to derive the source code of SonWeave AI Notes, except where mandatory law permits this.
4. User Content and Lawful Use
The user remains responsible for recordings, imported media, transcripts, notes, prompts, exports, and other content. The user must have all rights, permissions, and legal bases required to process, record, transcribe, export, or share it, including any consent required before recording other people.
SonWeave AI Notes must not be used for unlawful surveillance, prohibited covert recording, infringement of third-party rights, circumvention of technical protection measures, or any unlawful purpose. No rights in user content are transferred to the Provider.
Because SonWeave AI Notes is designed to process content locally and the Provider does not have access to that content, the user is solely responsible for ensuring that any material imported into or processed with the app may lawfully be used for that purpose. The user must not use SonWeave AI Notes to create, process, or share unlawful content or content that infringes the rights of others.
5. Automated Results
Transcripts, speaker labels, translations, summaries, chapters, questions, cleanup suggestions, and other automated results may be incomplete, inaccurate, or misleading. The user must review results before relying on or sharing them. SonWeave AI Notes is not a substitute for medical, legal, financial, safety-critical, or other professional advice.
6. Apple and Other Services
SonWeave AI Notes may use Apple Speech, CloudKit/iCloud, Foundation Models, Photos, Shortcuts, Spotlight, App Intents, system sharing, and optional model hosts. If the user enables iCloud Sync or deliberately exports, shares, or opens content in another app or service, Apple or the selected recipient processes the content under its own terms and privacy policy. The Provider does not control those services.
7. Warranty and Liability
Mandatory statutory rights, including the rights applicable to defective digital products, remain unaffected. The Provider is not responsible for uninterrupted availability, error-free operation, or error-free automated results to the extent permitted by law.
The Provider is liable without limitation for intent, gross negligence, injury to life, body or health, and liability that cannot legally be excluded. For slightly negligent breaches of material contractual duties, liability is limited to foreseeable, typical damage. Otherwise, liability is excluded to the extent permitted by law.
Apple may handle refunds for purchases made through the App Store. This does not exclude statutory claims against the Provider.
Backups and data loss. Before installing updates, users should create and verify an independent backup or export of important content. The Provider is not responsible for loss that could reasonably have been avoided by maintaining such a backup, except to the extent liability cannot be excluded under applicable law. Due to the local architecture of SonWeave AI Notes, recovery may not be technically possible.
8. Privacy
The Provider's Privacy Policy explains how personal data is handled. The Provider does not receive user content through its own servers. Apple and selected third-party recipients may process content when the user enables or initiates the relevant feature.
9. Consumers, Withdrawal, and Disputes
If the user is a consumer, mandatory consumer-protection rights of the user's country of habitual residence apply. Where a statutory withdrawal right applies to a paid digital purchase, it is governed by the applicable law and the purchase flow. Any loss of a withdrawal right for immediate digital delivery requires the legally required express consent and acknowledgement.
The Provider is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.
10. Governing Law
The law of Ireland applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not deprive them of mandatory protections of the law of the country in which they habitually reside. Courts in Ireland have jurisdiction to the extent permitted by applicable law; consumers may also bring claims before the courts available to them under mandatory law.
If any provision is invalid, the remaining provisions remain effective and the applicable statutory rule applies instead. The Provider may amend these Terms where reasonably necessary due to legal, technical, platform, or product changes, provided that mandatory rights are not restricted and users are not unreasonably disadvantaged.
